Paws and Order: Filing a Replevin to Retrieve Your Pup in the State of Ohio

Have you ever thought what would happen if someone ever refused to give your dog back due to a split or a dispute? Losing your dog can be a heart wrenching experience.  What rights do you have; how can you get your dog back you may ask? While your dog is a beloved member of your family, in the State of Ohio a dog is considered personal property. If someone is wrongfully holding your pet, you may be able to recover them through a process called Replevin.  

Step 1: Attempt to Resolve the Dispute Amicably

Sometimes, a simple demand letter can resolve the issue without going to court. Write a formal letter to the person holding your dog, stating your ownership and requesting the return of your pet by a specific date. Mention that you will pursue legal action if the dog is not returned. Consider Mediation if you would like to resolve the issue to split custody of your pet. 

Step 2: Gather Evidence of Ownership 

Before filing, gather all documents that prove you are the rightful owner of the dog. This can include: 

  • Adoption or purchase records. 

  • Veterinary records (showing you as the owner) 

  • Licensing or microchip information 

  • Photos/witness statements supporting your ownership.  

Step 3: Prepare and File a Complaint for Replevin 

If the dispute cannot be resolved amicably, you will need to file a Complaint for Replevin in the appropriate court. Typically, the complaint is filed where the dog is located. The filing of a Replevin requires specific documents to be filed. The Court may also require a posting of a bond. Once the Replevin is filed, the Defendant will be served with a summons and the complaint by the Court.

Step 4: Attend the Court Hearing 

Both parties will be required to attend a hearing set by the Court. You will need to bring all documentation to this hearing and be prepared to present your evidence. If the Judge rules in your favor, they will issue a Writ of Replevin, ordering the return of your dog.

Step 5: Enforcement of the Court Order 

If the defendant does not comply with the Writ of Replevin, some things to consider are to call local law enforcement or animal control and they may be able to assist you if you have clear proof of ownership and an order from the Court.
